GENERAL TERMS AND CONDITIONS OF USE AND SALE
NOTICE: Please read this document carefully. The services provided by ALCHEMY SKINCARE, S.L. (hereinafter, "TSA") through the website www.thespanishalchemist.com
(hereinafter, "Website") are subject to the conditions detailed below (hereinafter, "Terms and Conditions").
SCOPE OF APPLICATION
These Terms and Conditions regulate the provision of services and the acquisition of products through the TSA Website. The contracting and purchase of TSA products implies the full and unconditional acceptance of all the provisions contained herein. Not accepting these Terms and Conditions will make it impossible to contract the products and services offered.

1. DEFINITIONS
“TSA”: ALCHEMY SKINCARE, S.L.
“Customer”: Any User who accepts these Terms, accesses the Website, and purchases Products.
“User”: Any person who browses the Website, regardless of registration or purchase.
“Account”: Personal profile created by the Customer to manage orders.
“Order”: Specific request for freshly manufactured products for the Customer.
“Products”: Custom-made skincare formulas, manufactured “Just-in-Time” after order confirmation.
2. ACCOUNT REGISTRATION AND SECURITY
To purchase products, the User may register and activate a personal Account.
Confidentiality: Access credentials are confidential. The Customer is solely responsible for all activity on their Account.
Unauthorized Access: The Customer must immediately notify TSA at wecare@thespanishalchemist.com
if they suspect a security breach.
Suspension: TSA reserves the right to terminate or suspend accounts to protect the company or third parties from fraudulent activities or identity theft.
3. SERVICES AND PRODUCT DESCRIPTION
The Website provides an online sales platform for fresh, personalized skincare products.
Visuals: Descriptions are based on images and information owned by TSA. Every effort is made for accuracy, but slight variations in the appearance of raw active ingredients may exist.
Availability: All orders depend on the availability of active ingredients. TSA does not offer products that cannot be manufactured. If any material is unavailable, we will offer a substitute or a full refund.
4. “MADE TO ORDER” MODEL
The Customer acknowledges that TSA does not maintain stock. Each product is manufactured fresh after order confirmation. This personalized process guarantees maximum potency of active ingredients through encapsulation and airless technology.
5. PRICES AND TAXES
VAT: Prices include Spanish VAT unless otherwise indicated.
Shipping: Unless otherwise indicated, prices do not include shipping costs, which are added at the end of the order.
Errors: TSA is not bound by obvious pricing errors (typographical). In such a case, we will inform the Customer of the correct price, and they may cancel the order.
6. PURCHASE PROCESS AND ELECTRONIC CONTRACTING
By clicking "Confirm Purchase," the Customer enters into a binding electronic contract with TSA.
Payment: Orders are not processed until payment is authorized by the card issuer or payment gateway (Shopify Payments, PayPal, etc.).
Receipt: Upon completion, TSA will send an automatic email confirming order details. It is recommended to save a copy of the receipt.
7. SHIPPING AND DELIVERY
Territory: TSA ships exclusively within Spain (Peninsula).
Delivery times: TSA aims for delivery within 48 business hours from order confirmation.
Address: It is the Customer's responsibility to provide correct information. Subsequent changes are only possible if the laboratory has not yet started manufacturing.
Carrier Responsibility: TSA is not responsible for delays caused by the shipping company or third parties.
8. RETURNS AND RIGHT OF WITHDRAWAL (ART. 103 LGDCU)
IMPORTANT: According to Article 103 of the General Law for the Defense of Consumers and Users (LGDCU), the right of withdrawal (14-day "change of mind") does not apply to:
Goods made to measure or clearly personalized.
Sealed goods that cannot be returned for reasons of hygiene or health protection if unsealed after delivery.
As TSA products are made to order, all sales are final. Returns are only accepted for proven manufacturing defects or shipping damage, reported within 48 hours with photographic evidence.
9. INTELLECTUAL PROPERTY
All content on the Website (formulas, texts, images, trademarks, and logos) is the exclusive property of ALCHEMY SKINCARE, S.L. Any reproduction, distribution, or transformation without express written consent is prohibited.
10. PERSONAL DATA PROTECTION
Data processing is governed by our Privacy Policy and complies with the GDPR. Data is used solely for contract execution and, if authorized, for commercial communications via Klaviyo.
11. LIMITATION OF LIABILITY
TSA provides the Website as is. We do not guarantee that the site will be error-free or uninterrupted. TSA is not responsible for:
Technical failures of the internet or user devices.
Indirect damages, loss of profits, or business interruptions.
Allergic reactions (although we will offer support to find a solution).
12. FORCE MAJEURE
TSA is not responsible for breaches due to force majeure (fires, floods, earthquakes), war, strikes, or disruptions in the global supply chain of active ingredients.
13. MODIFICATIONS
TSA reserves the right to modify these Terms at any time. The version published at the time of purchase will be applicable to the Customer.
14. SEVERABILITY
If any clause of these Terms is declared null by a competent court, the other clauses will remain in full force and effect.
15. ENTIRE AGREEMENT
These Terms constitute the entire agreement between the Customer and TSA, replacing any prior oral or written communications.
16. JURISDICTION AND APPLICABLE LAW
These Terms are governed by Spanish Law. Any dispute will be submitted to the Courts of the city of Barcelona, Spain.
17. THE 48-HOUR LAB TO HOME PROMISE *
At The Spanish Alchemist, we manufacture daily in small batches. If items are in stock, we promise a 48 hours delivery depending on batch timing, delivery location, and product type. If not it will be based on when next batch is made which should be 5-6 days.By the time it arrives at your door- we ensure you're receiving a formula at its absolute biological peak.
